Please read these terms carefully before using Rogue Play. By accessing our platform, you agree to be bound by the following terms and conditions.

Acceptance of Terms

By accessing or using the Rogue Play platform ("Service"), including our website, applications, and cloud gaming infrastructure, you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, you may not access or use the Service.

These Terms constitute a legally binding agreement between you and Rogue Play. By creating an account, accessing our cloud gaming servers, or otherwise using the Service, you acknowledge that you have read, understood, and agree to be bound by these Terms and our Privacy Policy.

You must be at least 13 years of age to use the Service. If you are under 18, you represent that your parent or legal guardian has reviewed and agreed to these Terms on your behalf.

Description of Service

Rogue Play provides a cloud gaming platform that allows users to stream and play video games on compatible devices via the internet. Our Service renders games on remote servers and streams the audio-visual output to your device in real time, while transmitting your input commands back to our servers.

The quality of your experience depends on factors including but not limited to your internet connection speed, latency, network congestion, device capabilities, and geographic distance from our servers. Rogue Play does not guarantee a specific level of performance, resolution, or frame rate.

We may modify, update, or discontinue any aspect of the Service at any time, including game availability, server locations, supported devices, and features. We will endeavor to provide reasonable notice of material changes when practicable.

User Accounts

To access certain features of the Service, you must create an account. You agree to provide accurate, current, and complete information during registration and to keep your account information updated.

You are solely responsible for maintaining the confidentiality of your account credentials and for all activities that occur under your account. You must notify Rogue Play immediately of any unauthorized use of your account or any other breach of security.

Rogue Play reserves the right to suspend or terminate your account at any time if we reasonably believe that you have violated these Terms, or if your account has been compromised and poses a risk to the Service or other users.

You may not transfer, sell, or assign your account or any account rights to any third party without our prior written consent.

Subscriptions & Billing

Rogue Play offers subscription plans that provide access to our cloud gaming library and features. Subscription details, including pricing, billing cycles, and included features, are described on our pricing page and may be updated from time to time.

By subscribing, you authorize Rogue Play to charge your chosen payment method on a recurring basis at the then-current rate for your selected plan. Subscription fees are billed in advance for each billing period.

You may cancel your subscription at any time through your account settings. Cancellation takes effect at the end of the current billing period. No refunds or credits will be issued for partial billing periods, except as required by applicable law.

Rogue Play reserves the right to change subscription pricing with at least 30 days' prior notice. Continued use of the Service after a price change constitutes acceptance of the new pricing.

We may offer free trials or promotional pricing. Unless you cancel before the trial period ends, your subscription will automatically convert to a paid subscription at the standard rate.

Acceptable Use

You agree to use the Service only for lawful purposes and in accordance with these Terms. You are responsible for ensuring that your use of the Service complies with all applicable laws and regulations.

You may not:

  • Attempt to gain unauthorized access to our servers, systems, or other users' accounts
  • Use cheats, exploits, automation software, bots, hacks, or any unauthorized third-party software designed to modify or interfere with the Service
  • Reverse engineer, decompile, disassemble, or otherwise attempt to derive the source code of any part of the Service
  • Interfere with or disrupt the integrity or performance of the Service, including overloading our infrastructure
  • Use the Service to transmit any material that is unlawful, harmful, threatening, abusive, harassing, defamatory, or otherwise objectionable
  • Share your account credentials or allow others to access your account
  • Use the Service for any commercial purpose not expressly permitted by Rogue Play
  • Circumvent any access controls, usage limits, or digital rights management measures

Violation of these acceptable use provisions may result in immediate suspension or termination of your account without notice or refund.

Intellectual Property

The Service, including all software, technology, designs, trademarks, logos, and content created by Rogue Play, is the exclusive property of Rogue Play and its licensors. These Terms do not grant you any right, title, or interest in the Service except for the limited license to use it as described herein.

Games available through the Service are the property of their respective publishers and developers. Your access to games through the Service is subject to both these Terms and any additional terms imposed by the game publishers.

You retain ownership of any content you create or upload through the Service, such as gameplay recordings or user-generated content. By uploading content, you grant Rogue Play a non-exclusive, worldwide, royalty-free license to use, reproduce, modify, and display such content in connection with operating and promoting the Service.

Disclaimers

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, WHETHER EXPRESS, IMPLIED, OR STATUTORY. ROGUE PLAY DISCLAIMS ALL WARRANTIES, INCLUDING BUT NOT LIMITED TO IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.

Rogue Play does not warrant that the Service will be uninterrupted, error-free, secure, or free of viruses or other harmful components. We do not guarantee that any specific games will remain available, or that the Service will meet your specific requirements.

Cloud gaming performance is inherently dependent on network conditions beyond our control. Rogue Play disclaims responsibility for performance degradation caused by your internet service provider, local network conditions, or intermediary networks.

Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, ROGUE PLAY AND ITS OFFICERS, DIRECTORS, EMPLOYEES, AND AGENTS SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES ARISING FROM OR RELATED TO YOUR USE OF THE SERVICE.

IN NO EVENT SHALL ROGUE PLAY'S TOTAL AGGREGATE LIABILITY EXCEED THE AMOUNTS PAID BY YOU TO ROGUE PLAY IN THE TWELVE (12) MONTHS PRECEDING THE EVENT GIVING RISE TO THE CLAIM.

Some jurisdictions do not allow the exclusion or limitation of certain damages. In such jurisdictions, our liability is limited to the greatest extent permitted by law.

Termination

You may terminate your account at any time by contacting us or through your account settings. Termination does not relieve you of any obligations incurred prior to termination, including any outstanding payments.

Rogue Play may suspend or terminate your access to the Service at any time, with or without cause, and with or without notice. Grounds for termination include but are not limited to violation of these Terms, fraudulent or illegal activity, non-payment, and extended periods of inactivity.

Upon termination, your right to access the Service ceases immediately. Rogue Play is not obligated to retain any of your data or content after termination, except as required by applicable law.

Sections of these Terms that by their nature should survive termination will survive, including but not limited to intellectual property provisions, disclaimers, limitations of liability, and dispute resolution.

Governing Law & Disputes

These Terms are governed by and construed in accordance with the laws of the State of Delaware, United States, without regard to conflict of law principles.

Any dispute arising from or relating to these Terms or the Service shall first be attempted to be resolved through informal negotiation. If the dispute cannot be resolved within 30 days, either party may submit the dispute to binding arbitration administered by the American Arbitration Association under its Commercial Arbitration Rules.

You agree that any arbitration or legal proceeding shall be conducted on an individual basis and not as a class action or other representative proceeding. You waive any right to participate in a class action lawsuit or class-wide arbitration against Rogue Play.

Notwithstanding the foregoing, either party may seek injunctive or other equitable relief in any court of competent jurisdiction to prevent the actual or threatened infringement of intellectual property rights.

Changes to Terms

Rogue Play reserves the right to modify these Terms at any time. We will provide notice of material changes by posting the updated Terms on our website and updating the "Last Updated" date. For significant changes, we may also notify you by email or through the Service.

Your continued use of the Service after the effective date of any changes constitutes your acceptance of the modified Terms. If you do not agree to the updated Terms, you must stop using the Service and terminate your account.

We encourage you to review these Terms periodically to stay informed of any updates.
